We don’t charge you to use Basbes or the other products and services covered by these Terms. Instead, businesses and organizations pay us to show you ads for their products and services. By using our Service, you agree that we can show you ads that we think will be relevant to you and your interests. We use your personal data to help determine which ads to show you.
We don’t sell your personal data to advertisers, and we don’t share information that directly identifies you (such as your name, email address or other contact information) with advertisers.
Who we are
Basbes Inc. (“Basbes,” “we,” “us,” or “our”) provides messaging services via our mobile applications with messaging functionality (“Application”) .
Basbes builds technologies and services that enable people to connect with nearby users in the same place. These Terms govern your use of Basbes and the other products, features, apps, Services, technologies and software that we offer.
The service we provide
Our mission is to give people the power to communicate with nearby users. Unlike other dating services we don’t claim that we can find the perfect match for you, we believe that your life is the best dating app for you, we just give you the power to make the most of it.
Acceptance of Terms of Use Agreement
By creating a Basbes account, whether through a mobile device, mobile application or computer (collectively, the “Service”) you agree to be bound by (i) these Terms of Service, (ii) our Website Privacy Policy, Mobile App Privacy Policy, Cookies Policy, Safety Tips and Community Guidelines, each of which is incorporated by reference into this Agreement, and (iii) any terms disclosed and agreed to by you if you purchase additional features, products or services we offer on the Service (collectively, this “Agreement”). If you do not accept and agree to be bound by all of the terms of this Agreement, please do not use the Service.
We may make changes to this Agreement and to the Service from time to time. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. The most recent version of this Agreement will be posted on the Service under Settings and also on www.basbes.app, and you should regularly check for the most recent version. The most recent version is the version that applies. If the changes include material changes that affect your rights or obligations, we will notify you in advance of the changes by reasonable means, which could include notification through the Service or via email. If you continue to use the Service after the changes become effective, then you agree to the revised Agreement.
Modifying the Service and Termination
Basbes is always striving to improve the Service and bring you additional functionality that you will find engaging and useful. This means we may add new product features or enhancements from time to time as well as remove some features, and if these actions do not materially affect your rights or obligations, we may not provide you with notice before taking them. We may even suspend the Service entirely, in which event we will notify you in advance unless extenuating circumstances, such as safety or security concerns, prevent us from doing so.
Basbes may terminate your account at any time without notice if it believes that you have violated this Agreement. Upon such termination, you will not be entitled to any refund for purchases. After your account is terminated, this Agreement will terminate.
Account Terms
- You must be 18 years or older to use this Service.
- You must provide a valid information to complete the signup process.
- Use the same name that you use in everyday life .
- Provide accurate information about yourself.
- Create only one account (your own).
- You can not use our Service if you are a convicted sex offender.
- You can not use our Service if we’ve previously disabled your account for violations of our Terms or Policies .
- You are responsible for keeping your password secure. Basbes cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
- You may not use the service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
- You are responsible for all activity and content (data, graphics, photos, links) that is uploaded under your account.
- You must not transmit any worms or viruses or any code of a destructive nature.
- A breach or violation of any of the Account Terms as determined in the sole discretion of Basbes will result in an immediate termination of your services.
General Conditions
- We reserve the right to modify or terminate the Service for any reason, without notice at any time.
- We reserve the right to refuse service to anyone for any reason at any time.
- Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis without any warranty or condition, express, implied or statutory.
- Basbes does not warrant that the service will be uninterrupted, timely, secure, or error-free.
- Basbes does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
- You understand that your Content, may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
- We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
- You expressly understand and agree that Basbes shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
- Technical support is only provided via email or our social networks.
- You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by Basbes.
- Verbal or written abuse of any kind (including threats of abuse or retribution) of any Basbes customer, our employee, member, or officer will result in immediate account termination.
- We do not claim any intellectual property rights over the material you provide to the Service. All material you upload remains yours. You can remove your account at any time by deleting your account. This will also remove all content you have stored on the Service.
- The failure of Basbes to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Basbes and govern your use of the Service, superseding any prior agreements between you and Basbes (including, but not limited to, any prior versions of the Terms of Service).
- You retain ownership over all content that you submit to a Basbes account, however, by making your account public, you agree to allow other nearby users to view your content.
- Basbes does not pre-screen Content and it is in their sole discretion to refuse or remove any Content that is available via the Service.
- Questions about the Terms of Service should be sent to company’s email or social networks.
Rights We Grants You
Basbes grants you a personal, worldwide, royalty-free, non-assignable, nonexclusive, revocable, and non-sublicensable license to access and use the Service. This license is for the sole purpose of letting you use and enjoy the Service’s benefits as intended by Basbes and permitted by this Agreement. Therefore, you agree not to:
- use the Service or any content contained in the Service for any commercial purposes without our written consent.
- copy, modify, transmit, create any derivative works from, make use of, or reproduce in any way any copyrighted material, images, trademarks, trade names, service marks, or other intellectual property, content or proprietary information accessible through the Service without Basbes’s prior written consent.
- express or imply that any statements you make are endorsed by Basbes.
- use any robot, bot, spider, crawler, scraper, site search/retrieval application, proxy or other manual or automatic device, method or process to access, retrieve, index, “data mine”, or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
- use the Service in any way that could interfere with, disrupt or negatively affect the Service or the servers or networks connected to the Service.
- upload viruses or other malicious code or otherwise compromise the security of the Service.
- forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted to or through the Service.
- “frame” or “mirror” any part of the Service without Basbes’s prior written authorization.
- use meta tags or code or other devices containing any reference to Basbes or the Service (or any trademark, trade name, service mark, logo or slogan of Basbes) to direct any person to any other website for any purpose.
- modify, adapt, sublicense, translate, sell, reverse engineer, decipher, decompile or otherwise disassemble any portion of the Service, or cause others to do so.
- use or develop any third-party applications that interact with the Service or other members’ Content or information without our written consent.
- use, access, or publish the Basbes application programming interface without our written consent.
- probe, scan or test the vulnerability of our Service or any system or network.
- encourage or promote any activity that violates this Agreement.
The Company may investigate and take any available legal action in response to illegal and/ or unauthorized uses of the Service, including termination of your account.
Any software that we provide you may automatically download and install upgrades, updates, or other new features. You may be able to adjust these automatic downloads through your device’s settings.
Termination
- If your use of the Service is considered excessive (i.e. your bandwidth usage, data storage, or data input via email), your account’s access may be limited or your account terminated, at Basbes’s sole discretion.
- Accounts registered by “bots” or other automated methods are not permitted.
Cancellation
- You may cancel your account at anytime by emailing basbesApp@gmail.com.
- Once your account is cancelled all of your Content will be immediately deleted from the Service. Since deletion of all data is final please be sure that you do in fact want to cancel your account before doing so.
- We reserve the right to modify or terminate the Service for any reason, without notice at any time.
- Fraud: Without limiting any other remedies, Basbes may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.
Modifications to the Service
- Basbes reserves the right at any time to time to modify or discontinue, the Service (or any part thereof) with or without notice.
- Basbes shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
Safety; Your Interactions with Other Members
Though Basbes strives to encourage a respectful member experience through features like scratch to read covered messages and timed conversation that allows members to specify how long the conversation should be active, it is not responsible for the conduct of any member on or off of the Service. You agree to use caution in all interactions with other members, particularly if you decide to communicate off the Service or meet in person. In addition, you agree to review and follow Basbes’s Safety Tips prior to using the Service. You agree that you will not provide your financial information (for example, your credit card or bank account information), or wire or otherwise send money, to other members.
YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER MEMBERS. YOU UNDERSTAND THAT BASBES DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON ITS MEMBERS OR OTHERWISE INQUIRE INTO THE BACKGROUND OF ITS MEMBERS. BASBES MAKES NO REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF MEMBERS.
Community Rules
By using the Service, you agree that you will not:
- use the Service for any purpose that is illegal or prohibited by this Agreement.
- use the Service for any harmful or nefarious purpose.
- use the Service in order to damage Basbes.
- violate our Community Guidelines, as updated from time to time.
- spam, solicit money from or defraud any members.
- impersonate any person or entity or post any images of another person without his or her permission.
- bully, “stalk”, intimidate, assault, harass, mistreat or defame any person.
- post any Content that violates or infringes anyone’s rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract right.
- post any Content that is hate speech, threatening, sexually explicit or pornographic.
- post any Content that incites violence; or contains nudity or graphic or gratuitous violence.
- post any Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.
- solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other members or disseminate another person’s personal information without his or her permission.
- use another member’s account, share an account with another member, or maintain more than one account.
- create another account if we have already terminated your account, unless you have our permission.
Basbes reserves the right to investigate and/ or terminate your account without a refund of any purchases if you have violated this Agreement, misused the Service or behaved in a way that Basbes regards as inappropriate or unlawful, including actions or communications that occur on or off the Service.
Third Party Services
The Service may contain advertisements and promotions offered by third parties and links to other web sites or resources. Basbes is not responsible for the availability (or lack of availability) of such external websites or resources. If you choose to interact with the third parties made available through our Service, such party’s terms will govern their relationship with you. Basbes is not responsible or liable for such third parties’ terms or actions.
Definitions and legal references
Personal Data (or Data)
Any information that directly, indirectly, or in connection with other information — including a personal identification number — allows for the identification or identifiability of a natural person.
Usage Data
Information collected automatically through this Application(or third-party services employed in this Application), which can include: the IP addresses or domain names of the computers utilized by the Users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server’s answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User’s IT environment.
User
The individual using this Application who, unless otherwise specified, coincides with the Data Subject.
Data Subject
The natural person to whom the Personal Data refers.
Data Processor (or Data Supervisor)
The natural or legal person, public authority, agency or other body which processes Personal Data on behalf of the Controller, as described in this privacy policy.
Data Controller (or Owner)
